Vendor Terms & Conditions

Event Name: Black Like That Community Festival
Event Date: June 27, 2026
Location: The Hall at Ironworks
Hosted By: The Normal Anomaly Initiative, Inc. (“Festival Organizer”)

By submitting payment and/or participating in the Black Like That Festival (“Festival”), Vendor agrees to the following Terms & Conditions:


1. Vendor Eligibility & Approval

  • All vendors must complete the official vendor application form.

  • Submission of an application does not guarantee acceptance. If not accepted, payment will be refunded in full.

  • The Festival Organizer reserves the right to approve or deny any vendor at its sole discretion.

  • Vendor categories may be capped to ensure a diverse set of offerings.

  • All products and services must align with the Festival’s values and mission.


2. Vendor Fees & Payment

  • Vendor fees are listed in the official vendor application.

  • Full payment is required to secure vendor space unless otherwise stated.

  • Vendor fees are non-transferable without written approval.

  • Any outstanding balance must be paid by the stated deadline, or vendor space may be forfeited.


3. Refund & Cancellation Policy

  • Vendor fees are non-refundable unless the Festival is canceled by the Organizer.

  • If Vendor cancels:

    • 100% refund if canceled 60 days prior.

    • 50% refund if canceled 30-60 days prior
    • No refunds after May 27, 2026.

  • If the Festival is postponed due to circumstances beyond the Organizer’s control (weather, government restrictions, force majeure), vendor registration will transfer to the rescheduled date. Refunds are not guaranteed.


4. Space Assignment & Setup

  • Booth placement is determined solely by the Festival Organizer. Sponsors receive priority placement.

  • Vendors must operate within their assigned space.

  • Subleasing or sharing vendor space without approval is prohibited.

  • Setup and breakdown times will be communicated in advance.

  • Vendors must be fully set up by the designated opening time.

  • Early breakdown is not permitted without written approval.


5. Permits, Licenses & Compliance

Vendor is responsible for:

  • Obtaining all required local, state, and federal permits and licenses.

  • Securing applicable sales tax permits.

  • Collecting and remitting all sales taxes.

  • Complying with all health department regulations (food vendors).

  • Meeting fire marshal requirements if applicable.

Failure to provide required documentation may result in removal without refund.


6. Insurance Requirements

All vendors must carry general liability insurance.

Minimum coverage requirements:

  • $1,000,000 per occurrence

  • $2,000,000 aggregate

Certificate of Insurance must:

  • Name The Normal Anomaly Initiative as Additional Insured

  • Cover the full event date(s), including setup and breakdown

Food vendors may be required to carry additional product liability coverage.


7. Indemnification & Liability

Vendor agrees to:

  • Assume full responsibility for any injury, loss, or damage caused by Vendor’s employees, contractors, products, or operations.

  • Indemnify and hold harmless the Festival Organizer, sponsors, venue, staff, volunteers, and partners from any claims, damages, or legal actions arising from Vendor participation.

The Festival Organizer is not responsible for:

  • Theft

  • Property damage

  • Weather damage

  • Lost revenue

  • Equipment malfunction


8. Products & Conduct

  • Only approved products may be sold.

  • Counterfeit or unauthorized merchandise is strictly prohibited.

  • No weapons, illegal substances, or discriminatory materials.

  • Vendors must maintain a professional and respectful presence.

  • Amplified music at booths is prohibited unless approved.

The Organizer reserves the right to remove vendors who violate these standards without refund.


9. Power & Equipment

  • Power availability is limited and must be requested in advance.

  • Vendors must provide their own extension cords, power strips, and equipment.

  • Generators may require prior approval.

  • The vendor is responsible for properly securing all tents and equipment.


10. Cleanliness & Waste

  • Vendors must keep their area clean throughout the event.

  • All trash must be properly disposed of.

  • Food vendors must comply with regulations governing grease and wastewater disposal.

  • Failure to clean the vendor space may result in additional fees.


11. Security

General event security may be provided; however:

  • Vendors are responsible for safeguarding their own property.

  • Overnight security (if applicable) does not guarantee protection of vendor goods.


12. Marketing & Promotion

  • Vendors may promote their participation in the festival/

  • The Festival Organizer may photograph or record vendor booths and products for promotional use without compensation.


13. Force Majeure

The Festival Organizer shall not be liable for cancellation or interruption due to:

  • Severe weather

  • Acts of God

  • Government restrictions

  • Public health emergencies

  • Civil unrest

  • Circumstances beyond reasonable control


14. Default & Removal

The Festival Organizer reserves the right to:

  • Remove any vendor in violation of these Terms.

  • Reassign vendor space if necessary.

  • Refuse participation in future events.

No refund will be issued for vendor noncompliance.


15. Agreement

By submitting payment and participating in the Black Like That Festival, Vendor acknowledges that they have read, understood, and agreed to these Terms & Conditions.

Food Vendor Addendum

(Supplement to Vendor Terms & Conditions)

This Food Vendor Addendum (“Addendum”) applies to all vendors preparing, cooking, serving, sampling, or selling food and/or beverages at the Black Like That Community Festival (“Festival”). This Addendum is incorporated into and governed by the Festival Vendor Terms & Conditions.


1. Health Department Compliance

Food Vendor agrees to:

  • Comply with all local, county, and state health department regulations.

  • Obtain all required temporary food establishment permits.

  • Provide copies of permits to the Festival Organizer by the stated deadline.

  • Be present for and pass any required onsite inspections.

Failure to obtain required permits may result in immediate removal without refund.


2. Food Safety Standards

Food Vendor must:

  • Maintain proper food storage temperatures:

    • Cold foods at 41°F or below

    • Hot foods at 135°F or above

  • Follow proper food-handling procedures at all times.

  • Wear gloves or use utensils when handling ready-to-eat food.

  • Ensure all food preparation areas remain sanitary.

  • Protect food from contamination (dust covers, sneeze guards where applicable).

Festival Organizer reserves the right to inspect vendor setups for compliance.


3. Handwashing & Sanitation

Vendor must provide:

  • A functioning handwashing station (if required by local regulations), including:

    • Warm running water

    • Soap

    • Paper towels

    • Catch bucket for wastewater

  • Adequate sanitizer solution for food prep surfaces.

  • Separate wash/rinse/sanitize bins if required.

Improper sanitation may result in a shutdown by event officials or the health department.


4. Equipment & Fire Safety

If using cooking equipment, the Vendor must:

  • Use flame-retardant tents (documentation may be required).

  • Secure all tents with proper weights.

  • Keep fire extinguishers on-site:

    • Minimum 2A:10BC extinguisher required

    • K-class extinguisher is required for grease-producing equipment

  • Comply with fire marshal guidelines.

  • Maintain safe distances between cooking equipment and the public.

Propane tanks must be secured and in good condition.


5. Water & Waste Disposal

Vendor is responsible for:

  • Bringing potable water if required.

  • Proper disposal of wastewater (not in storm drains or landscaping).

  • Safe grease disposal in accordance with local regulations.

  • Removing all trash and food waste from the vendor space.

Dumping grease or wastewater improperly may result in fines and removal.


6. Insurance Requirements (Food Vendors)

In addition to general vendor insurance requirements, the Food Vendor must carry:

  • General Liability Insurance ($1,000,000 per occurrence minimum)

  • Product Liability coverage (included in GL policy or separate)

Certificate of Insurance must name:
The Normal Anomaly Initiative, Inc., as Additional Insured.


7. Food & Beverage Exclusivity

  • The vendor may only sell items approved in their application.

  • Unauthorized menu additions require written approval.

  • The Festival Organizer reserves the right to limit duplicate menu items to ensure vendor diversity.


8. Alcohol Sales (If Applicable)

No outside alcohol is permitted.

Unauthorized alcohol sales will result in immediate removal.


9. Sampling & Portion Control

  • Free samples must be approved in advance.

  • Samples must comply with health department regulations.

  • Vendors are responsible for maintaining safe crowd flows around their booth.


10. Power & Generators

  • Power access is limited and must be requested in advance.

  • Generators must be quiet-operation models and approved prior to the event.

  • Extension cords must be outdoor-rated and properly secured.

Festival Organizer does not guarantee uninterrupted power.


11. Clean-Up & Breakdown

  • The vendor must leave the space in its original condition.

  • All grease, trash, food waste, and equipment must be removed.

  • Failure to properly clean the space may result in additional cleaning fees and/or disqualification from future events.


12. Indemnification

Food Vendor assumes full responsibility for:

  • Foodborne illness claims

  • Allergic reactions

  • Improper food handling incidents

  • Injury caused by cooking equipment or setup

Vendor agrees to indemnify and hold harmless the Festival Organizer, sponsors, venue, and partners from all claims arising from food operations.
